Welcome to The Borrowed Couture, operated by The Borrowed Couture Pty Ltd. By using our website or mobile apps, you agree to the following terms and conditions. If you're lending items, you're an Owner or Lender. If you're renting items, you're a Renter or Borrower. We reserve the right to change these terms and conditions at any time, and your continued use of our website or mobile apps means you agree to the changes. We suggest that you read these terms and conditions every time you use our website or mobile apps.
Scope
We run the website and mobile apps that connect Renters and Lenders of designer clothing. Transactions are between Renters and Lenders, but all users of our services must follow these Terms and Conditions. If a Lender has any additional rules, Renters and Lenders agree to follow those rules as long as they don't conflict with our Terms and Conditions. Our Terms and Conditions are also subject to any Insurance providers' Terms and Conditions. If insurance is provided, the Lender and/or Renter will receive the Insurance Terms and Conditions before completing the booking.
What We Provide?
We provide services to adults over 18 years old. By using our website or mobile apps, you confirm that you're over 18 years old. Our prices are listed in Australian Dollars (AUD) and don't include GST unless stated otherwise. We try to keep our price list updated, and you can find it on our home page or mobile apps. Users who list items can change their prices at any time. We're not responsible for any damage caused by price changes.
Bookings
We offer rental products to adults over 18 years old. By using our website or mobile apps, you confirm that you're over 18 years old. While we strive to keep our product list updated, we cannot guarantee the availability of any product advertised on our website.
Our fees and charges are available on our home page, and we reserve the right to change them at any time.
When you place an order, we'll ask for your name, delivery address, email address, phone number, credit card details, and any other information we need. We'll take care of your information, but we're not responsible for any misuse caused by transmission errors, viruses, or malware.
Payments
We will transfer the rental price and any associated costs received from the renter to the lender's account, minus the service fee to be retained by us. This will occur within 72 hours of the rental period's commencement date, provided the booking was made at least 7 business days in advance. If the booking was made less than 7 business days in advance of the rental period, we will transfer the funds within 72 hours of the commencement date and after 7 business days from the booking date.
If a renter or lender initiates a dispute resolution process, we reserve the right to withhold any payments owed to the lender. Please refer to the cancellation policy below for more information.
Delivery
If you select the delivery service, the delivery charges will be included in the checkout total. Lenders rely on third-party providers for delivery services. Neither we nor the Lender will be liable if the estimated delivery timelines are not met due to postal failures or delays. If you don't receive a delivery on time, please inform the Lender right away.
Cancellations
Since providing Designer Clothing for a specific date may prevent others from renting it, cancellations are subject to certain restrictions, as outlined below. Please note that cancellations may affect your review and rating.
As a Renter, you can cancel a request, but you may not be able to cancel a booking after a Lender has accepted your request.
If your booking request is accepted, you can cancel it up to 14 days before the expected Delivery Date and receive a refund. Refunds may take up to 10 days to process.
Bookings made within 14 days of the expected Delivery Date are non-refundable, and bookings that are not cancelled before 14 days of the Delivery Date are also non-refundable.
If a Lender cancels a confirmed booking, they may be subject to cancellation penalties, which may include reasonable fees as determined by us. However, in rare cases of extenuating circumstances, such as death in the family, serious illness, natural disasters, political unrest, or damage to the clothing by a previous Borrower, we may waive the cancellation penalties upon receipt of proper documentation, where valid.
